Since launching in 2019, Arran Capital successfully invested in public sector entity litigation matters. Most notably, it funded a qui tam (whistleblower) case that returned multi-million-dollar recoveries to the claimant and Arran Capital investors. This investment started generating investment returns 10 months after investment capital commitment (which is extremely quick in recovery realization while producing an outstanding IRR). After initial conversations indicate a good fit, and following the execution of an NDA, our work shifts to underwriting and due diligence. Underwriting is the critical analysis of investments to select desirable opportunities. This goes beyond the merits of claims to consider extrinsic factors affecting the chances of a favorable recovery. Some factors rely on common sense, and others are technical.

There are hundreds of potential legal claims that could benefit from legal financing. However, not every claim is a good candidate for financing. Arran Capital recognizes that while each potential claim is considered on its merits, it is important to listen and respond to additional concerns and questions of our claimant and law firm partners.

Our responsiveness and insight in this respect acknowledges that success is built upon trust and foundational relationships. If one claim is not a good candidate for funding, that may mean it could improve in time and be funded then. Or, if one claim is not a good candidate for funding, another prospective claim may align with an appropriate financing deal.
